Acceptable Use Policy

This Acceptable Use Policy applies to all customers using the products and services of George Datacenter LLC. It aims to protect the security, integrity, reliability, and privacy of our network and services.

Prohibited Uses

  • Posting or transmitting illegal, abusive, obscene, or defamatory material.
  • Installation or distribution of unlicensed software.
  • Deceptive marketing or excessive automated traffic.
  • Introducing malicious software (viruses, trojans, worms, etc.).
  • Causing security breaches, denial of service, or unauthorized access.
  • Sending spam or unsolicited emails, including “junk mail” or “chain letters”.
  • Crypto mining, mass mailing, and port scanning are strictly prohibited.
  • Hosting or transmitting streaming services, live broadcasts, or media relay servers.
  • BitTorrent:: GD does not allow BitTorrent, you may not run any bit torrent application/script, tracker, or client, and will suspend/terminate any offending account
  • Other Prohibited Activities: Any activity that may disrupt service stability, degrade network performance, or violate applicable laws or third-party rights is prohibited, even if not explicitly listed above. This includes but is not limited to: abusive behavior toward support staff, unauthorized traffic relaying, use of anonymizers/proxies for illegal purposes, and any operation that exposes the infrastructure to legal or operational risk.

Abusable Resources

Customers must secure all open resources such as mail relays or amplifiers. Continued abuse after notification is a violation of this policy.

Resource Usage Policy (CPU, Bandwidth & Disk I/O)

George Datacenter LLC operates shared infrastructure optimized for typical workloads. To ensure fair resource allocation and optimal performance for all customers, we enforce transparent usage policies based on sustained averages rather than momentary peaks.

CPU Fair Use Policy

Our VPS plans run on high-performance shared servers. To ensure a stable service for all our customers, CPU usage is subject to the following conditions:

You may use 100% of your assigned vCPUs without restriction for short-term tasks. However, if your VPS maintains an average usage above 70% of your vCPUs for more than 2 consecutive hours, we will apply a temporary restriction until your consumption returns to normal levels.

If the situation recurs, your VPS will be temporarily suspended until you contact our support team. In the event of proven malicious use, your service will be immediately cancelled with no right to a refund.

Network Fair Use Policy

All our VPS plans include a 1 Gbps port with no monthly transfer limit. To ensure a stable experience for all our customers, the following conditions apply:

You may use your 1 Gbps port freely for any short-term task. However, we measure your average usage over a rolling 2-hour window. If your average exceeds 500 Mbps over 2 hours, your speed will be temporarily reduced to 250 Mbps and will be automatically restored the following day.

If the situation recurs, your VPS will be temporarily suspended until you contact our support team. In the event of proven malicious use, your service will be immediately cancelled with no right to a refund.

Disk Fair Use Policy

All our VPS plans run on high-speed NVMe storage shared among multiple instances. To ensure stable performance for all our customers, the following conditions apply:

You may use the disk freely for any normal task. However, if your VPS sustains more than 1,000 IOPS or 100 MB/s for more than 30 consecutive minutes, we will temporarily reduce your disk access to 500 IOPS / 50 MB/s until consumption returns to normal levels. The restriction is automatically lifted after 1 hour.

If the situation recurs, your VPS will be temporarily suspended until you contact our support team. In the event of proven malicious use, your service will be immediately cancelled with no right to a refund.

Account Activation

Unmanaged VPS servers are usually activated within 1–6 hours, dedicated servers within 72 hours depending on stock and customization.

Payment, Chargebacks, and Disputes

Chargebacks or disputes filed with payment processors place the account in bad standing and may result in immediate termination without refund.

Lease IP Policy

Failure to renew leased IPs upon contract expiration and continued use will result in suspension of all active services.

Refunds

Due to provisioning and maintenance costs, refunds are not offered. Any approved refund will be issued as account credit.

IP Allocation

All IP addresses are assigned per ARIN policy and remain property of the datacenter. Allocations are revoked upon service termination.

Zero Tolerance Spam Policy

Sending spam results in immediate suspension or removal. Cleanup fees apply if our IPs are blacklisted due to unsolicited mail.

Cancellation Policy

Requests must be submitted at least 72 hours before the next due date. Dedicated servers and IP rentals require 30-day renewal confirmation.

Payment Policy

Invoices are issued 16 days before due date. Services are suspended 3 day after overdue and terminated after 6 days. Reactivation may incur a $25 fee.

Affiliate Commission Policy (One-Time Payment)

Commissions apply only to valid sales of new customers who have not previously held an active service.

  • Commissions are paid once per referred order, not on renewals or recurring payments.
  • For monthly billing, the referred service must remain active for at least 60 days.
  • For annual billing, the referred service must remain active for at least 45 days.
  • If the order is canceled, refunded, or charged back within that period, the commission is voided or deducted from future payouts.
  • Renewals do not generate new commissions. Only the first purchase qualifies.
  • The company reserves the right to verify all referred transactions and withhold commissions in case of fraud or policy violation.

Promotions

Promotional prices are guaranteed only until the end of the contract period. Renewal prices may differ.

Client Data Backup Policy

George Datacenter LLC does not provide automatic backup services for customer files, databases, or hosted content. Clients are solely responsible for backing up their data regularly. Manual backup options may be available upon request as a courtesy, but these are not guaranteed or scheduled.

Important: We strongly recommend maintaining your own backup solutions. George Datacenter LLC is not liable for any data loss.

Customer Records Retention Policy

George Datacenter LLC retains customer account records, invoices, and billing history only for the current calendar year. Records from previous years are permanently deleted to maintain storage efficiency and data security.

Limitation of Responsibility

George Datacenter LLC, its officers, employees, or affiliates shall not be liable for any direct or indirect damages, including data loss or unauthorized access.

Service Level Agreement (SLA)

George Datacenter LLC guarantees a network uptime of 99.9% per month. Scheduled maintenance and external network outages are excluded. If uptime falls below this level, clients may request a service credit equivalent to the downtime percentage of the affected billing cycle.

Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts of Delaware.

Indemnification

The Customer agrees to indemnify, defend, and hold harmless George Datacenter LLC, its employees, agents, and affiliates from and against any and all claims, damages, liabilities, losses, and expenses (including legal fees) arising out of or related to the misuse of our services or violation of these Terms.
